Live Birth
Guarantee Defined
Seller guarantees a live cria will be born to the bred female.
The live birth guarantee is satisfied if the cria survives 30 days
after birth. If Dam Owner claims the guarantee is not
fulfilled, then Dam Owner shall provide proof from a licensed
veterinarian that the cria died within 30 days after birth and the
cause of death in the event that the pregnancy produces a viable
fetus. A necropsy report must also be provided. Live birth
guarantee is void if death occurs due to negligence by the Dam
Owner or a death as the result from a trauma. Preventable deaths
are not covered under this guarantee. If the dam loses the fetus
prior to delivery by absorption or miscarriage, proof of such
event shall be required within 11 months of the departure of the
dam from Stud Owner, or within 30 days of discovery the dam no
longer is carrying a viable fetus, whichever occurs first. This
guarantee is voided if any vaccinations are given in the last
trimester, if rebreed is done by Buyers using a male that is not
owned by Champion Alpacas or if the viable fetus dies prior to 30
days due to negligence on the part of the Buyer.
For Purchased Bred Females:
Re-breed must be done within 60 days of loss of cria or discover
of absorption/stillborn. Buyer will be responsible for transport
of the female to and from the Seller’s ranch. Any
re-breeding option shall be exercised by Dam Owner within 60 days
or said rebreeding option shall be deemed to be waived by
non-use. Buyer will bear all
costs associated with the rebreeding option. This warranty is made
in lieu of any and all other warranties expressed or implied,
including the warranties of merchantability and fitness.
For Purchased
Breedings:
Re-breed must be done within 60 days of loss of cria or discover
of absorption/stillborn. Buyer will be responsible for transport
of the female to and from the Stud owner's ranch. Any re-breeding
option shall be exercised by Dam Owner within 60 days or said
rebreeding option shall be deemed to be waived by non-use. If the
conditions above are satisfied to show the live birth guarantee
has not been satisfied, then the Dam Owner's exclusive remedy
shall be entitled to either a full refund or a free rebreeding,
with the Stud Owner exercising the choice of which option will be
provided to the Dam Owner. Dam Owner will bear all costs
associated with the rebreeding option. This warranty is made in
lieu of any and all other warranties expressed or implied,
including the warranties of merchantability and fitness.
